Probate, Estates and Trust Administration

Mississippi law requires that every administrator or executor probating an estate be represented in court by an attorney. Probate is often a confusing and complex process. We will provide advice and assistance to you during the probate process. If you are appointed executor, you are responsible for determining assets of the estate, paying claims probated against the estate and finally distributing the remaining assets to the beneficiaries. This often involves transferring assets from the estate into a trust created under the decedent’s will.

We will be glad to assist you if you are the executor in carrying out your duties under the decedent’s will and Mississippi Law. As your attorney, we will assist you as the executor of the estate in preparing the petition to open the estate, assisting with the identification and gathering of assets, payment of expenses, filing estate tax returns and assisting you in performing your fiduciary duties. Our representations will continue through all stages of the probate process, including discharging you as the executor, closing the estate and distributing the assets according to the will.
